FinPerx may qualify as a "financial institution" under the GLBA based on the nature of its revenue-based financing activities. To the extent GLBA applies, the following applies to our collection and use of "nonpublic personal information" (NPI):
We collect NPI — including financial information and personal identifiers — to evaluate financing applications and provide financing services.
We share NPI with service providers who assist us in providing financing services, subject to confidentiality obligations.
We do not share NPI with unaffiliated third parties for their own marketing purposes without your authorization.
We maintain a written information security program designed to protect NPI from unauthorized access, disclosure, or misuse.
6. Data Retention
We retain your information for as long as necessary to fulfill the purposes described in this Policy, unless a longer retention period is required by law. Specifically:
Application data for declined applicants is retained for a minimum of 25 months to comply with ECOA record-keeping requirements.
Data for funded merchants is retained for the duration of the financing relationship and for a period thereafter as required by applicable law and our internal record-keeping policies.
Marketing contact data is retained until you opt out or request deletion, subject to legal hold requirements.
When information is no longer needed and no legal retention obligation applies, we securely delete or de-identify it.
7. Your Privacy Rights
7.1 California Residents (CCPA / CPRA)
If you are a California resident, the California Consumer Privacy Act (CCPA), as amended by the California Privacy Rights Act (CPRA), gives you the following rights:

Right to Correct: You may request that we correct inaccurate personal information we maintain about you.
Right to Opt Out of Sale or Sharing: We do not sell or share personal information for cross-context behavioral advertising as defined by the CPRA.
Right to Limit Use of Sensitive Personal Information: To the extent we collect "sensitive personal information" as defined by the CPRA, you may have the right to limit certain uses of that information.

7.3 All Users — Opt-Out of Marketing
Regardless of your state of residence, you may opt out of marketing communications at any time by clicking "unsubscribe" in any marketing email or by contacting us at contact@finperx.com. Opting out of marketing will not affect our ability to send you transactional communications related to an active application or financing agreement.
8. Data Security
We implement administrative, technical, and physical safeguards designed to protect your information from unauthorized access, use, disclosure, alteration, or destruction. These measures include:
Encryption of data in transit using TLS/HTTPS

Contractual data security requirements for all service providers who handle personal information

No data transmission over the internet or electronic storage system is perfectly secure. While we take reasonable precautions, we cannot guarantee absolute security. If you believe your information has been compromised, please contact us immediately at contact@finperx.com.
